Who Does Your Agent Represent?

Real estate practices around the country are changing and as a result of recent reforms in disclosure law, new options for representation are available for buyers and sellers. How would you like to be represented?

A seller's agent, also known as a listing agent, works for and protects the seller's best interest. A seller's agent has a signed contract, (the listing contract), and works with loyalty and fidelity as the seller's advocate and negotiator. A buyer's agent works exclusively for the buyer. The agent serves the buyer with undivided loyalty, confidentiality and full disclosure. With the cost and complexity associated with today's real estate purchases, more and more homebuyers are choosing to equip themselves with the services of an Accredited Buyer Representative (ABR). A dual agent can work for both the buyer and the seller by written, informed consent of both parties with limited fiduciary duties to both. The dual agent can only disclose to one party what the other party allows to be revealed. Although a dual agent cannot disclose confidential information about one party to the other, the dual agent is still able to provide information about the property to the buyer, to disclose all latent material defects, to help the buyer compare financing alternatives and to provide information on comparable properties so that both parities may make educated decisions on the price.

A subagent is a cooperating agent who works on behalf of the listing agent in the sale of a property. The subagent represents the seller, and works with the buyer but not for the buyer. A subagent may not assist a buyer in any way that would be detrimental to the seller, but the buyer can expect the subagent to treat them honestly and fairly. The subagent is able to provide information about the property to the buyer, to disclose all latent material defects, to help the buyer compare financing alternatives and to provide information on comparable properties so that the buyer may make educated decisions on the price.
